The Forbes Funds maintains the Consultant Directory as an information and referral resource for the nonprofit sector in Southwestern Pennsylvania.  The Forbes Funds does not endorse any specific consultant listed, nor does it require or even consider the use of any consultant listed in the Consultant Directory by a nonprofit organization when evaluating grant proposals.  By using the Consultant Directory, the user consents to these Terms and Conditions. 

While The Forbes Funds may exercise its discretion in including or excluding consultants from the Consultant Directory, it does not make any representation or warranty regarding the quality of specific consultants listed in the Consultant Directory or the work performed by them.  The Forbes Funds does not license, certify or review qualifications of any of the consultants listed in the Consultant Directory. The Consultant Directory is provided as an informative place to start your search for a local consultant and does not serve as an endorsement or recommendation for any individual consultant by The Forbes Funds. 

It is the sole responsibility of the user to check references, insurance and other relevant information prior to engaging in business with any consultant listed in the Consultant Directory. 

The Consultant Directory is dynamic and may change WITHOUT NOTICE.  Users of the Consultant Directory are fully responsible for checking the accuracy, completeness, currency and suitability of the consultants listed in the Consultant Directory. 
 
The listings in the Consultant Directory are entirely self-reported, and are based solely on information provided to The Forbes Funds by the consultants. In this regard, The Forbes Funds cannot and does not offer any guarantees as to the accuracy of the information or the effectiveness or quality of the work provided. It is up to the user to use the information from the Consultant Directory to contact those consultants who seem most appropriate for the work the user has in mind, and to discuss and negotiate with the consultant the terms and conditions of the work involved and any resulting agreement.

The Consultant Directory is subject to the provisions of The Forbes Funds’ Privacy Policy.

The user releases The Forbes Funds from any damages, unresolved disputes, or other liabilities arising from information obtained from the Consultant Directory or use of any consultant listed in the Consultant Directory.


THE FORBES FUNDS EXPRESSLY DISCLAIMS ANY AND ALL EXPRESS OR IMPLIED WARRANTIES, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.  THE FORBES FUNDS SHALL NOT BE LIABLE TO THE USER FOR LOST PROFITS, LOST BUSINESS OR OPPORTUNITIES, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, PUNITIVE OR EXEMPLARY DAMAGES OF ANY KIND WHATSOEVER, WHETHER OR NOT FORESEEABLE (INCLUDING, WITHOUT LIMITATION, ATTORNEYS' FEES) IN ANY WAY DUE TO, RESULTING FROM, OR ARISING IN CONNECTION WITH THE CONSULTANT DIRECTORY.  

The user agrees to defend, indemnify and hold The Forbes Funds harmless from and against any and all losses, damages, liabilities, claims, demands, suits and expenses (including reasonable attorney’s fees) arising out of use of the Consultant Directory by the user and/or use by the user of any consultant listed in the Consultant Directory.  

If any provisions of these terms and conditions are deemed invalid or unenforceable under applicable law, the remaining provisions will continue in full force and effect.  These terms and conditions shall be governed by the laws of the Commonwealth of Pennsylvania.  The user hereby consents to the jurisdiction of the Commonwealth of Pennsylvania and venue of Allegheny County. These terms and conditions cannot be modified or amended in any way except in a writing specifically referencing these terms and conditions and signed by the user and The Forbes Funds.
